The API is supposed to be atomic though, and the code in Nova is dependent on this. The scenario why is in the Neutron bug report and I could potentially trigger the race failure if I made this min_count>2, i.e. hitting an error of network ambiguity.

I was also thinking that L161 above would fail but I guess the 2nd server would get the network id from the first, even if there was a 2nd network created which was going to be deleted later.

I still worry about the case in the bug, with 3 concurrent requests, the first creates the real (valid) network, the 2nd doesn't see it and creates a 2nd duplicate network, but the id from the first comes back from the neutron API, but a 3rd request does a listing of tenant private networks and gets both of those networks back, nova will fail with an ambiguous network error.

Granted, this is only on the first attempt to boot *any* number of instances for a specific tenant, after that it shouldn't be an issue. But I worry about devops CI/CD test runs where people setup a fresh tenant for each run and then burst let's say 100 servers into it.
At this point though the servers have already booted, so asserting the number of networks for the tenant is not giving us any sort of assurance, and hence I am suggesting to remove it.
